Wedding Terms and Conditions

1. Agreement

By signing this Wedding Information Form, the Client agrees to the terms and conditions outlined below. This agreement is between the Client and https://www.kolecava.com/, hereinafter referred to as "the Company."

2. Services Provided

The Company agrees to provide wedding videography services as detailed in the Wedding Information Form. Any additional services requested by the Client that are not specified in this form may incur additional charges.

3. Payment Terms

A non-refundable deposit of 50% of the total cost is required to secure the booking. The remaining balance is due 3-7 days before the wedding date. If the balance is not paid by this date, the Company reserves the right to cancel the booking.

4. Cancellation Policy

The Client may cancel this contract at any time by providing written notice to the Company. The following cancellation fees apply:

  • Cancellation less than [1 month] before the wedding date: [25%] of the total cost.
  • Cancellation less than [3 months] before the wedding date: [10%] of the total cost.

The deposit is non-refundable regardless of the cancellation date.

5. Rescheduling

If the wedding is rescheduled, the Company will make reasonable efforts to accommodate the new date. If the new date is not feasible for the Company, the cancellation policy will apply or alternative video production team could be sourced (prices may vary).

6. Liability

The Company will take all reasonable steps to provide high-quality services. However, the Company is not liable for circumstances beyond its control, including but not limited to weather conditions, equipment failure, or accidents. The Company's liability for any claim, loss, or damage shall be limited to the amount paid by the Client for the services.

8. Music Licensing

All music used in the wedding video will be sourced from Artlist.io. This ensures that all music is properly licensed, preventing any legal copyright issues related to the use of copyrighted music. The Client acknowledges and agrees to the use of music from Artlist.io for their wedding video. Copyright can be sourced if requested and price may vary.

9. Client Responsibilities

The Client is responsible for providing accurate information and ensuring that the schedule and events outlined in the Wedding Information Form are adhered to. Any changes to the schedule must be communicated to the Company in advance (at least 1 week prior to the wedding).

10. Model Release

The Client grants the Company the right to use images and footage of the wedding for promotional purposes, including on the Company's website, social media, and marketing materials.

11. Delivery

The Company will deliver the final edited video within 4 weeks after the wedding date. The Client will receive [number of copies/formats] as specified in the Wedding Information Form.

11b. Delivery Formats

Depending what package you have chosen, the following delivery formats may be available to you.

  1. Delivery of 3 1080x1920 (9:16) up to 15 seconds highlights for stories for social media channels (included in ALL packages)
  2. Up to 5 minute wedding highlight in 4K UHD 3840x2160 (16x9) or 3840x1600 (2.40) depending on the project
  3. Up to 20 minute wedding film in 4K UHD 3840x2160 (16x9) or 3840x1600 (2.40) depending on the project
  4. Basic cut of the Ceremony in 4K UHD 3840x2160 (16x9) or 3840x1600 (2.40) depending on the project
  5. Basic cut of the Speeches in 4K UHD 3840x2160 (16x9) or 3840x1600 (2.40) depending on the project

12. Dispute Resolution

Any disputes arising from this agreement will be resolved through negotiation in good faith. If a resolution cannot be reached, the dispute will be settled through mediation or arbitration in accordance with the laws of England and Wales and if applicable, the European Union.

13. Entire Agreement

This agreement constitutes the entire understanding between the Client and the Company. Any amendments or additions to this contract must be made in writing and signed by both parties.

14. Data Protection

The Company will comply with all applicable data protection laws in the UK and EU, including the General Data Protection Regulation (GDPR). Personal data collected from the Client will be used solely for the purpose of providing the services outlined in this agreement and will not be shared with third parties without the Client's consent.

15. Governing Law

This agreement shall be governed by and construed in accordance with the laws of England and Wales and if applicable, the European Union. Any legal proceedings arising out of or in connection with this agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16. Drone

The use of drones for capturing footage is subject to approval and can only be operated in designated and approved areas as per local regulations and safety guidelines. Should it be determined that drone operation is not feasible due to legal, safety, or environmental constraints, the Drone Service will not be provided. In such cases, the Client will be informed in advance, and no liability will be assumed by the Company for the inability to provide drone footage.
